NORTHEAST AERO R/C CLUB

BYLAWS

I. The club's officers shall consist of a President, Vice-President, Secretary, Treasurer, and Public Relations Officer. These officers shall stand for election annually, and shall be elected or reselected by a majority vote of the membership present at the November monthly meeting. Officer nominations will take place at the October Monthly meeting. These officers shall make up the executive committee. In turn, these officers may appoint or set up various committees to handle the business of the club. A simple majority vote of the membership present at any regular monthly meeting may be asked for as consent.

No member may serve as an officer while serving as an officer in another flying club.

Any officers may be removed from office by a two-thirds (2/3) majority vote of the membership present at any regular monthly meeting.

Treasury Regulations:

1. All checks, regardless of amount, written from the club bank account must have the signature of both the treasurer and president. Only the current treasurer and president are permitted to be authorized check writers on the club's bank account.

2. Any check written from the club bank account for an amount greater than $25 must require the approval of a majority vote at a club meeting.

II. A member can only be terminated by a two-thirds (2/3) majority vote of the membership present at any regular monthly meeting. A vote for termination shall be taken after reviews and recommendation by the Executive Committee. Various reasons for termination should include, but not be limited to, non-payment of dues, refusal to adhere to club rules, or any other reason the club, as a majority, deems appropriate. There shall be no refund of dues or other moneys to a member when said member is terminated.

RESIGNATION, TERMINATION, DISCIPLINARY ACTION, EXPULSION AND REINSTATEMENT OF MEMBERSHIP

1. Any member in good standing may resign his/her membership by giving written notice to the Club.

2. If any member ceases to have the qualifications necessary for membership in the AMA, his/her membership in The Club shall thereby terminate, subject to reinstatement upon restoration of eligibility.

3. This section provides for enforcement of the Safety Rules that are related to flying activities. Any other unacceptable behavior by an individual member or members, as defined by the Board of Directors, become the responsibility of the Board of Directors. Any individual may be expelled from membership from the club by a two-thirds (2/3) majority vote of the Board of Directors if, in the Board of Directors determination, such individual willfully commits any act or omission which is a violation of any of the terms of these Articles of Incorporation and Bylaws, or the rules of the AMA, or which is detrimental to the club, the AMA, or to model aviation.

4.  Any member who is expelled from membership may be reinstated to membership only by two-thirds (2/3) majority vote of the Board of Directors.

5. The Board of Directors shall have the disciplinary authority to provide for and to impose disciplinary action for such acts or omissions, which do not justify expulsion from membership.

III. All club memberships and flying privileges expire on December 31 of each year. Each member must renew their membership by filling out a renewal form and paying dues for the new year. The officers of the club will send membership renewal forms to the membership by December 15 each year.


IV. Dues structure shall be as follows:

Adult membership dues are $120.00 per year.

Annual dues are to be paid by January 31.

Renewing members, new members, and past members rejoining the club who pay their annual dues by January 31 may take a $30.00 discount. Therefore, anyone paying their dues by January 31 will pay $90.00 for their annual dues.

New and renewing members paying after January 31 will pay $120.00 for their annual dues.

New members' second year dues will be pro-rated based on the quarter that they join the club. A new member is one who was not a member during the previous calendar year.

Join January to March pay annual dues the second year - $90.00 by Jan. 31; $120.00 after Jan. 31

Join April to June pay ¾ annual dues the second year - $68 by Jan. 31; $90.00 after Jan. 31

Join July to September pay ½ annual dues the second year - $45 by Jan. 31; $60.00 after Jan. 31

Join October to December pay ¼ annual dues the second year - $23 by Jan. 31; $30.00 after Jan. 31

A lifetime membership to the club is available for $1,000.00.

Junior memberships are free through age seventeen (17) or until the junior member is out of high school. Once a junior member becomes eighteen and is out of high school said member must become a paying member. Junior members are non-paying and therefore denied voting privileges. Those under eighteen may become paying members if they desire to do so. AMA membership is still required of junior members.

No one will have flying privileges unless their dues are current.

V. There will be no consumption of or possession of either alcoholic beverages or any illegal drugs allowed or tolerated at the flying site. Any person arriving at the site in an intoxicated or similar condition will be banned from flying and asked to leave the premises.

VI. Proof of current Academy of Model Aeronautics (AMA) membership is required for all members and flying guests in order to fly at the club flying field.

VII. The Academy of Model Aeronautics (AMA) safety flying code shall be followed and will be enforced.

VIII. Northeast Aero R/C Club shall not be held responsible for personal property and/or injury at club sponsored events. All items are the responsibility of the owner.

IX. These Bylaws shall remain irrevocable and unchangeable except by a two-thirds (2/3) majority vote of members present at any regular monthly meetings and shall run with the club throughout its existence.

X. DISSOLUTION

1. The Corporation may be dissolved with the approval of a two-thirds (2/3) majority vote of the total membership.

2. Upon the dissolution of the Corporation, the Board shall, after paying or making provision for the payment of all of the liabilities of the Corporation, dispose of all the assets of the Corporation exclusively for the purposes of the Corporation in such manner, to the Academy of Model Aeronautics, Inc., or to such other organization or organizations organized and operated exclusively for charitable, educational, religious, or scientific purposes as shall at the time qualify as an exempt organization or organizations under Section 501(c)(3) of the Internal Revenue Code of 1986, as amended, or to such other organization with purposes similar to the purposes of this Corporation, as the Board shall determine. Any of such assets not so disposed of shall be disposed of by the Court of Common Meas (or similar court) of the county in which the principal office of this Corporation is then located, exclusively for such purposes and to such organization or organizations, as said court shall determine, which are organized and operated exclusively for such purposes.

XI. GRIEVANCE PROCEDURE (FLIGHT AND GROUND SAFETY RULES)

1. Purpose

The grievance procedure provides a mechanism to enforce existing safety rules by providing a progressive disciplinary system when needed. Although most complaints can be resolved informally, if a complaint is serious or cannot be resolved informally, the matter should be referred to the Safety Committee for its consideration by means of a Grievance Form to be filled out and turned in to the Safety Committee Chairman. At least one witness is required to sign the Grievance Form.

2. Safety Committee

The safety Committee shall use its judgment in carrying out action on the following:

(a) A Grievance Form (see page 9) will be filled out and turned in to the Safety Committee Chairman. At least one witness is required.

(b) FIRST VIOLATION

a. Viewpoints of both complainants and accused will be considered.

b. Complainants name will be disclosed.

c. A verbal reprimand will be given to the accused by the Safety Committee, and this will be recorded in the Committee files.

(c) SECOND VIOLATION

a. Complainants name will be disclosed.

b. The accused has the right to a written rebuttal, to be reviewed by the Committee.

c. If the Committee so decides, the flying privileges of the accused will be suspended for thirty (30) days.Written notice of this shall be issued and a copy published in the Club newsletter.

(d) THIRD VIOLATION

a. Committee will notify the accused in writing and the Club members via the Club newsletter that the Club will vote on the expulsion of the accused at the next meeting.

b. Said expulsion will last for a one-year minimum. (Longer if deemed necessary by the Board of Directors).

c. A member may be expelled from the Club only upon a two-thirds (2/3) majority vote of the membership present at the meeting.

d. Voting will be by secret ballot at a regular monthly meeting.

e. The expelled member may reapply for membership after the expiration of the expulsion period.

(e) The three actions will not be enforced unless they are accumulated within a two-year period of time.

(f) Any member receiving a Grievance, who directs any retaliation action against the person filing said Grievance, will be subject to immediate expulsion from the Club. This is to include threats, intimidation, physical harm, intentional equipment damage, or any other action deemed to be retaliatory by the Board of Directors.
